Acceptance and Scope
These Family Album Terms of Use (the “Terms”) are an agreement between you and INVOICENOW Limited (“we,” “us,” or “our”) regarding your download of, access to and use of Family Album (the “App” or the “Service”).
By downloading or opening the App, creating or joining a family group, uploading content, purchasing a subscription or otherwise using the App, you acknowledge that you have read, understood and agreed to these Terms and the Family Album Privacy Policy. If you do not agree, please do not use the App.
The App may be used in countries and regions where the Service may lawfully be provided. Nothing in these Terms limits any consumer, privacy or other statutory rights that cannot be excluded by contract in your place of residence.
Eligibility and Children’s Data
The App is intended only for adults who have reached the legal age of majority where they live and are at least 18 years old. Minors may not independently create or join a family group or independently manage a subscription or a child’s profile.
The App is designed for parents, guardians and authorized adult family members to preserve and share information about a baby’s or child’s growth. Before uploading a baby’s profile image, nickname, date of birth, photos, videos, location or other child-related data, you must make sure that you have lawful authority to do so and have obtained any consent required by applicable law from a guardian or other relevant person.
If you do not have the right to provide particular child-related data, a photo of another person or family information, do not upload it. We may restrict access, remove relevant content or suspend an account when we receive a valid complaint or legal request, or identify an evident risk.
The Service
Family Album is a private family album for invited family members. Its primary features include:
- creating a family group or joining one through a valid invitation;
- setting a member’s relationship to a baby and using the Service with administrator or regular-member permissions;
- creating and managing baby profiles;
- selecting and uploading photos or videos from the system photo library;
- associating photos or videos with one or more babies;
- browsing family memories by capture date and viewing, downloading or sharing content through system sharing features;
- adding photo descriptions, text comments or emoji reactions;
- receiving notifications about family activity, interactions, upload results and subscription status; and
- using purchase, restore-purchase and other subscription-related features.
The App does not offer a public community, stranger discovery or a public feed. Family content is displayed only within the relevant family group. Family members may nevertheless send content outside the App through downloads, screenshots or system sharing features. You should invite only trusted family members and carefully choose what you upload.
On-Device Photo Recognition
After you authorize access to your system photo library, the App may use Apple Vision to analyze accessible photos on your device and display a prompt marker on photos that may contain a baby or child.
This feature provides suggestions only:
- it will not automatically upload photos or videos before you confirm your selection;
- it is not used to identify a particular child and does not create a facial identity profile;
- results may be inaccurate, incomplete or incorrect, and the final selection is yours;
- baby-recognition analysis is not performed on videos; and
- local recognition results and home-screen search history are processed and stored only on your device and are not used as cloud AI training data.
Member Identity, Family Groups and Security
The App does not require you to provide an email address or password, or to use Sign in with Apple. When you choose to create or join a family group, the system automatically creates an anonymous member identity and generates a member identifier, device session and the family permission records needed to provide the Service. An identity created automatically in this way is also considered an account under these Terms.
You must appropriately safeguard your device, family invitation code and invitation link, and must not provide them to anyone you do not trust. To the extent permitted by law, you are responsible for the relevant risk of access to family content resulting from your voluntary sharing of an invitation code, failure to protect your device or allowing another person to operate your device.
A family group has two roles: administrator and regular member. Administrators may invite or remove members, adjust roles and relationships, and manage baby profiles and family content. Regular members may browse and upload content, post comments or emoji reactions, and manage information that they are authorized to modify. The specific permissions available are those shown in the App.
User Content and License
“User Content” means information that you provide, upload, create or share through the App, including baby profiles, photos, videos, capture times, locations, descriptions, comments and emoji reactions.
You retain the rights you lawfully hold in your User Content. To provide family album, cloud storage, synchronization, display, download, sharing, backup, security review and technical support features, you grant us a non-exclusive, worldwide, royalty-free license, limited to what is necessary to provide the Service, to host, copy, transmit, process, reformat and display User Content to the relevant family members, and to delete User Content in accordance with your actions. This license does not transfer ownership of your User Content to us.
You represent and agree that you will:
- hold lawful rights in the content you upload or have obtained sufficient authorization for it;
- not upload content that infringes privacy, copyright, portrait or publicity rights, or other lawful rights and interests;
- not upload content that is unlawful, fraudulent, threatening, harassing, hateful, pornographic, exploitative of children or harmful to others;
- not use the App to distribute malicious software, gain unauthorized access or interfere with operation of the Service; and
- not misleadingly impersonate another person or misuse family invitation features.
An uploader may delete content they uploaded, and an administrator may manage family content in accordance with family management rules. We may also restrict access, remove content or suspend the Service when we reasonably believe that content is unlawful, infringing, harmful to child safety, threatening to Service security or in breach of these Terms.
Leaving a Family, Removing a Member, Dissolving a Family and Deleting an Account
Different actions have different consequences:
- Leaving a family or being removed from a family: If other members remain in the family group, we will delete or disassociate the account’s member record, permissions, family relationships and related personal profile data in that family group. To preserve the continuity of family memories, photos, videos, descriptions, comments and emoji reactions that the member shared with the family group may remain in the original family group, disassociated from the former member’s identity or otherwise de-identified. If you are the only administrator of a family group that still has other members, you must appoint a new administrator before leaving or deleting your account.
- Dissolving a family: If only one member remains in a family group and that member confirms that they wish to leave, the action will become a family dissolution. Following dissolution, the family group, member information, baby profiles, photos, videos, descriptions, comments, emoji reactions and other family data will enter the permanent deletion process.
- Deleting an account and all personal data: This is different from simply leaving a family or being removed from one. You may initiate complete account deletion through the account deletion entry point in the App. Except for data that we are legally required to retain, we will delete the automatically created account, member identity, related personal data and User Content associated with that account, including photos, videos, descriptions, comments and emoji reactions. If the account is the only remaining member of a family group, deleting the account will also dissolve the family. Deleting an account does not automatically cancel an auto-renewing subscription managed by an app store; you must manage the subscription separately in the relevant app store.
To prevent accidental deletion, we may require you to confirm again within your current valid session. Specific deletion timelines and backup-clearing rules are described in the Family Album Privacy Policy.
Subscriptions, Purchases and Refunds
Some features of the App may require a paid subscription, one-time purchase or other in-app purchase. The products, billing periods, prices, free-trial conditions, scope of benefits and renewal information are those shown on the purchase screen and by the relevant app store before you confirm a purchase.
Purchases are completed using the native in-app purchase system of the platform you use: Apple App Store/StoreKit on iOS and Google Play on Android. RevenueCat is used to receive and validate purchase credentials, synchronize subscription status, provide entitlements and support purchase restoration. We do not directly obtain your full bank card details or app-store account payment credentials.
A valid purchase status is used to provide the benefits shown on the purchase screen to the current Family Album family group. This is an internal family-group benefit rule within the App and is not Apple’s Family Sharing or an app-store family subscription. The specific benefits remain subject to what is shown on the purchase screen and in the App.
Purchases and subscriptions are managed through the app-store account used to make the purchase and are not subject to the role permissions of a family administrator or regular member.
Auto-renewal, billing timing, cancellation, purchase restoration and refunds are governed by the rules of the relevant app store. Unless expressly stated otherwise on the purchase screen, an auto-renewing subscription will continue until you cancel it in your app-store account settings. Deleting the App, leaving a family group or deleting your account does not automatically cancel an app-store subscription.
If we change a price or benefit, we will notify you through the purchase screen, an in-App notice or a method required by the app store.
Privacy and Permissions

You decide whether to grant photo library, notification and tracking permissions. Refusing a permission may prevent the corresponding feature from working, but we will not restrict basic features that are unrelated to that permission. We access the IDFA or perform cross-app advertising attribution that requires App Tracking Transparency permission only after obtaining system authorization.
The App does not display third-party advertising, but after you authorize it, we may use the IDFA and Singular to measure promotion sources and marketing performance.
Third-Party Services
The App uses third-party services including Apple, Google Firebase, Mixpanel, Singular and RevenueCat to provide cloud storage, anonymous identity, push notification, analytics, crash diagnostics, advertising attribution, purchase validation and subscription management capabilities.
Third-party services may be governed by their own terms and privacy policies. We require service providers to process data only for agreed purposes, but we cannot control every processing activity independently determined by an app store, operating system or third-party service. The specific services, data types and purposes are described in the Family Album Privacy Policy.
Intellectual Property and Feedback
Except for User Content, the App’s software, interfaces, brands, text, graphics, code and other content are lawfully owned by us or the relevant rights holders. Without written permission, you may not copy, modify, reverse engineer, rent, sell, distribute or otherwise exploit them, except where expressly permitted by applicable law.
If you submit product suggestions or feedback to us, you agree that we may use them to improve and develop the Service without disclosing your identity or paying you. Such use does not affect any rights you lawfully hold in pre-existing material included in the feedback.
Service Changes, Interruptions and Termination
We may modify, suspend or discontinue part of the Service because of product improvements, security, maintenance, legal requirements, changes to third-party services or force majeure. Where reasonably practicable and required by law, we will provide advance notice of material changes.
Internet connections, cloud services, device systems and third-party platforms may experience interruptions. We take reasonable measures to maintain the Service, but do not guarantee that it will be error-free or continuously available at all times, in all regions, on all devices or in all network environments.
If you materially breach these Terms, endanger child safety, infringe another person’s rights, commit fraud or threaten Service security, we may restrict, suspend or terminate your use of the Service and handle the relevant content to the extent permitted by law.
Disclaimers and Limitation of Liability
The App is a family photo management and sharing tool. It does not provide medical, parenting, legal or other professional advice. On-device photo recognition provides suggestions only and does not guarantee accurate or complete results.
To the fullest extent permitted by applicable law, we are not liable for losses caused by network interruptions, device failures, failures of third-party platforms, user error, a user’s external sharing of content or unauthorized use of an invitation code, where those matters are beyond our reasonable control.
Nothing in these Terms excludes or limits liability arising from fraud, willful misconduct or gross negligence, or affects rights you have under mandatory consumer protection laws in your place of residence.
Updates to These Terms
We may update these Terms in response to changes in features, data processing, law or operations. We will notify you of material changes through an in-App notice, an updated page or another reasonable method and will state the new effective date. Where the law requires us to obtain consent again, we will do so before continuing the relevant processing.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without affecting any mandatory statutory rights that cannot be excluded by contract in your place of residence.
The parties should first attempt to resolve any dispute arising from these Terms or the Service through the contact email address below. If a dispute cannot be resolved through consultation, it will be submitted to a court of competent jurisdiction in the Hong Kong Special Administrative Region. Where applicable law permits you to assert rights before a court in your place of residence, that law will apply.
